Ian Ridd is a commercial / civil law practitioner with a broadly based practice in commercial litigation and arbitration, employment, professional negligence and professional disciplinary and regulatory work. In the commercial field, he has particular expertise in the fields of insurance, sale of goods, product liability, carriage of goods and banking and securities law.

Ian also specialises in claims relating to land, in particular those involving boundary disputes and in proceedings before the Upper Tribunal (Lands Chamber).

Ian’s employment practice covers contentious work across the whole spectrum of employment law, principally, but not exclusively acting for employers. He handles cases in both the Employment Tribunals, the EAT and the High Court.

In the field of professional negligence, Ian acts for both Claimants and Defendants, principally dealing with claims against Solicitors, Barristers, Valuers, and Construction Professionals.

In the Disciplinary and Regulatory field, Ian handles a wide range of cases before the Solicitors Disciplinary Tribunal. He also represents other professionals before their own Disciplinary and Regulatory bodies.

Ian has been a Fellow of the Chartered Institute of Arbitrators since 1994 and sits as an arbitrator in commercial disputes.

He is also an Accredited Mediator. Ian accepts instructions to act as a mediator, with a particular interest in the mediation of disputes involving insurance and employment issues.
Ian is licensed to undertake public access work and does so on a regular basis, particularly in the employment field, for both employers and employees.

Ian appears regularly against leading counsel and is widely regarded for his ability to master the essential points in a case and to put them plainly and persuasively to the Court. He has a particular reputation as a forceful cross-examiner. Solicitors praise his approachability, his ability ‘to get on with clients’, his ability to problem-solve, to assess the merits of a case and to give clear and practical advice throughout.

Commercial

Ian has particular experience and expertise in disputes, either in court or in arbitration proceedings, arising out of the sale of goods and the carriage of goods by land or air.

Ian has advised or acted in many cases for commercial borrowers and lenders involving disputes and claims for possession arising out of mortgages and other secured lending over real property.

Ian’s arbitration work has involved appearing as advocate in arbitration hearings, both ad hoc and also under the rules of the LCIA, the ICC and UNCITRAL, in a wide range of disputes, involving not only disputes in the commercial field, but also construction arbitrations and arbitrations concerned with the rental values of commercial properties.

Disciplinary

Ian has broad experience of acting for professionals before the disciplinary, regulatory and appeal bodies of their regulators, acting in particular for lawyers and accountants. He is widely regarded for his ability to provide sound and knowledgeable practical and tactical advice to those facing such proceedings.

Ian is also instructed by the SRT and the SDT in proceedings in the High Court arising out of interventions and in applications for judicial review in connection with disciplinary proceedings.

Ian sits regularly as a Chairman of the Disciplinary, Regulatory and Appeal Committees of the Association of Chartered Certified Accountants, (‘ACCA’).

Employment

Ian’s employment practice covers the whole spectrum of employment law, including partnerships and LLP’s. In Employment Tribunals, he appears in and advises in relation to the larger claims involving unfair dismissal, redundancy, all forms of discrimination, whistleblowing claims, and also transfer of undertakings cases.

He is also instructed in High Court cases, involving representation and advice in matters involving wrongful dismissal, constructive dismissal, boardroom disputes, breach of confidence, breach of fiduciary duty, restrictive covenants and injunctions. He regularly advises and acts for major City corporate clients and financial institutions. He also has considerable experience of industrial relations and trade union law, including trade union recognition.

Insurance

Ian has extensive experience of handling cases involving disputed claims under policies of insurance, acting principally for insurers.

Cases in which he has regularly been instructed have involved claims:

  • In which insurers have sought to avoid liability for material non-disclosure or misrepresentation.
  • In which insurers have sought to avoid liability for breach of warranty.
  • In which insurers have sought to avoid liability for late notification of claims.
  • In which insurers have sought to avoid liability to pay claims, particularly fire claims, on the ground of fraud.
  • Quantifying the loss of gross profit under Business Interruption policies between insurers and brokers concerning the right of insurers to have access to, and to inspect, brokers’ records and premium accounting documents.

Mediation

Ian has been an accredited mediator since 2005. He accepts appointments as a mediator across the fields of commercial and employment disputes.

In addition he regularly appears at mediation hearings to represent the interests of clients participating in the mediation process.

Professional Negligence

In the professional liability field, Ian has considerable experience, acting both for Claimants, and also for the insurers of professionals, in cases involving principally Solicitors, Barristers, Architects, Quantity Surveyors and Valuers and Insurance Brokers. He has particular experience of cases involving lawyers’ liability: claims arising out of lost or mishandled litigation, mishandled settlements of litigation, commercial disputes and property transactions.

Regulatory

Ian has broad experience of acting for professionals before the disciplinary, regulatory and appeal bodies of their regulators, acting in particular for lawyers and accountants.
