Rajiv Bhatt has a wide ranging practice with a particular focus on: employment, sports, general commercial litigation, insurance, personal injury and clinical negligence.
In relation to his employment law practice, Rajiv represents both employers and employees in complex multiday trials. Most notably, he successfully represented Meseret Kumulchew in her sex and disability discrimination, victimisation and whistleblowing case against Starbucks. The case received considerable press coverage: BBC, The Independent, The Guardian and The Times. The case also featured in the Equal Opportunities Review.
Rajiv has a developing and exciting employment law practice. He regularly acts for both employees and employers in complex multiday trials which include discrimination, victimisation, whistleblowing and TUPE. He has a particular interest in disability discrimination claims.
Rajiv also appears in preliminary hearings ranging from general case management to strike outs and applications to amend.
Rajiv has experience of drafting appeals and appearing in the Employment Appeal Tribunal.
Rajiv is happy to draft pleadings and provide advice.
Rajiv has a particular interest in commercial law. He has an LLM in Commercial Law from the University of Cambridge which has provided him with a solid basis upon which to build a commercial practice.
Rajiv has been involved in a wide range of commercial disputes during his time at Reed Smith. For example he worked on disputes concerning the construction of charterparty contracts, sale of goods and conflict of laws.
Rajiv welcomes instructions in all cases concerning sports. He is a member of the Sport Resolutions Pro Bono Legal Advice Panel
Prior to coming to the Bar Rajiv assisted in the case of Dwain Chambers v British Olympic Association  All ER (D) 255. The case concerned the British sprinter Dwain Chambers’ application for an interim injunction preventing the British Olympic Association from applying a byelaw which made him ineligible for selection as a member of Team GB for the 2008 Beijing Olympics.
Rajiv has worked in a firm of insurance loss assessors. He acted for policy holders dealing with household insurance claims. Rajiv’s work included advising on interpretation of policy wordings, working with insurance loss adjustors and drafting appeals to the Financial Ombudsman Service.
Rajiv has experience of cases involving road traffic accidents, employers’ liability and stress at work. He regularly appears in the county courts and also has a busy paperwork practice drafting pleadings, advices and schedules of loss.
Rajiv has a developing clinical negligence practice. During pupillage he worked on the case of Packham v Hazari  EWHC 3951 (QB), a clinical negligence trial concerning an allegation of a negligent provision of information by a consultant plastic surgeon.
Rajiv has successfully represented a doctor in relation to an MPTS hearing. Rajiv made written representations following which the Case Examiner decided not to refer the matter to a full hearing.
Rajiv regularly represents both claimants and defendants in credit hire cases.
Rajiv is happy to accept instructions in this area. During pupillage he advised on a potential professional negligence case against a firm of solicitors and a barrister.
Kamara v MCCH (UKEAT /0221/16/RN)
Rajiv acted for the Respondent, MCCH, which is a charity that provides support to people with learning disabilities, autism and mental health needs. Mr Kamara was employed as a case worker. A complaint was made by the mother of a service user about the manner in which Mr Kamara had cared for her disabled son. The matter was investigated, and Mr Kamara was subsequently dismissed for gross misconduct. Mr Kamara brought an Employment Tribunal claim containing various allegations, one of which was that his dismissal was an act of race discrimination. Rajiv successfully obtained a strike out of all of the claims brought by Mr Kamara on the basis that the claims had no reasonable prospects of success. Mr Kamara appealed to the Employment Appal Tribunal. Rajiv again successfully argued that Mr Kamara’s appeal had no reasonable prospects of success.
D v The Walt Disney Company Limited (2016)
Rajiv acted for a producer at the Disney Channel who is disabled in her claim concerning the failure to make reasonable adjustments.
H v Secretary of State for Justice (2016)
Rajiv is currently acting for H, a probation officer, in her race discrimination, victimisation and whistleblowing case against the Secretary of State for Justice.
Kumulchew v Starbucks ET Case no 2201217/2014
Ms Kumulchew is employed as a Qualified Shift Supervisor at a Starbucks store. She is dyslexic and struggles with reading, spelling and comprehension with information. She was disciplined for "falsifying" a health and safety book. Ms Kumulchew maintained that she had made a mistake which was attributable to her dyslexia. This was largely ignored. Ms Kumulchew also did various protected acts. The tribunal found that Ms Kumulchew was victimised, subjected to detriments as a result of whistleblowing and discriminated against on the grounds of her sex and disability. The case has raised considerable awareness of dyslexia in the workplace.

Prior to coming to the Bar Rajiv trained as a commercial solicitor at the international law firm Reed Smith LLP. Whilst at Reed Smith, Rajiv was involved in the high profile age discrimination case of John McCririck v Channel 4 and IMG Media (Case no: 2200478/2013). Rajiv also worked on commercial disputes ranging from intellectual property to shipping, insurance and finance law. Rajiv’s experiences at Reed Smith have allowed him to understand the needs of solicitor clients and thereby provide an effective and tailored service.
Rajiv enjoys playing and watching all manner of sports including football, cricket and swimming. He is also currently learning to play the piano.
