Joshua Hedgman will appear in the Court of Appeal on Monday 27 & Tuesday 28 July, instructed by Faith Guppy of DWF, representing Transport for London in a case about the safety of the stepped cycle track infrastructure that can be found on parts of its Cycle Superhighway network.
The Claimants both cycled into the kerb at the edge of the cycle track, but established liability at trial subject to significant reductions for contributory negligence of 70% and 65%. The Court of Appeal is expected to resolve the trial Judge’s perception of a tension between the common law principles that (1) negligent road users fall within the duty owed in respect of hazards on the road, however (2) no duty is owed to protect road users against hazards that are obvious.
