Our probate practice includes disputes concerning the validity, construction and rectification of wills, as well as claims arising during the administration of estates. Members are frequently instructed in challenges based on lack of capacity, undue influence, fraud or forgery, and in claims under the Inheritance Act, including associated claims for proprietary estoppel.
We are also regularly instructed in disputes arising during the administration of estates, including applications to remove executors or trustees, claims for breach of trust, negligence, devastavit or wilful default, and actions to recover estate assets from beneficiaries or third parties. Our experience also extends to related private client and commercial disputes, including TOLATA claims, partnership disputes, and unfair prejudice petitions.
Our members’ experience in Court of Protection matters includes advising on both property and affairs and personal welfare matters. Instructions range from deputyship applications and financial management to complex disputes involving HNW individuals who lack capacity. Our barristers are experienced in matters concerning serious medical treatment decisions, deprivation of liberty safeguards, and the management of vulnerable individuals’ personal and financial affairs.
A particular strength of the team lies in the multi-disciplinary practices of our members. Many combine expertise in probate, personal injury and clinical negligence, which is especially valuable where disputes turn on questions of mental or physical capacity. Members regularly work with leading medical experts, including geriatricians and psychiatrists, and are highly experienced in presenting and testing complex medical evidence at trial.
