Lewis joined Chambers in October 2022 following the successful completion of his pupillage. He accepts instructions in all of Chambers’ core areas of practice with a specific focus on insurance related matters.

Lewis appears in court regularly, instructed on behalf of claimants and defendants in application and costs hearing, as well as at trial.  Lewis also has busy paperwork practice and accepts instructions to advise on liability, quantum, and tactics, as well as for drafting pleadings, schedules of loss, and counter schedules.

Lewis has significant experience in insurance coverage and property damage matters, having recently been seconded within an international law firm, where he handled a number of multi-million pound coverage disputes acting on behalf of insurers.

Prior to joining Chambers Lewis worked in the litigation department of a specialist insurance law firm, acting on behalf of insurers in all aspects of fast and multi-track litigation. From this role Lewis worked as Assistant Counsel for a global Lloyd’s of London Managing Agent where he assisted in a number of areas including the negotiation of contracts, policy wording disputes, and claims litigation both domestically and internationally.

Property Damage

Lewis has a busy property damage practice. He acts in a variety of property damage and construction disputes, including damage by flood, fire, and other catastrophic events. He is regularly instructed by Claimants and Defendants and has experience in pursuing subrogated recovery and third party claims.

Recent successes include negotiating the settlement of a £6 million pound coverage dispute following mediation, and obtaining strike out in the High Court of a fire damage claim pleaded in excess of £2 million.

Other recent cases include:

  • Acting on behalf of a statutory water undertaker in a claim following catastrophic flood damage following the allegedly defective installation of pipework.
  • Acting for a property developer in a claim for flood damage made by a neighbouring property owner following the allegedly negligent design and construction of a new build development.
  • Acting on behalf of a homeowner (via their insurer) following an extensive fire which caused by a defective battery within an e-bike.
  • Acting on behalf of a homeowner (via their insurer) in respect of damage suffered as a result of Japanese knotweed emanating from the neighbouring property.

Insurance

Lewis has extensive experience of insurance disputes. He regularly acts and advises in a variety of matters ranging from policy wordings and coverage disputes to liability contests and subrogated recoveries.

Lewis has significant experience in the insurance market having worked previously as Assistant Counsel in a Lloyd’s of London Managing Agent and being seconded within an international insurance law firm.

Some recent cases include:

  • Advising a travel insurer on a potential coverage defence in respect of a significant claim for medical expenses.
  • Acting on behalf of an insurer in respect of a coverage dispute following the alleged theft of insured property where allegations of dishonesty were raised.
  • Advising an insured in respect of a claim in excess of £500,000 made against an insurer pursuant to the Third Party (Rights Against Insurers) Act 2010 whereby the insurer had raised potential coverage defences and sought to avoid the underlying policy.

Personal Injury

Lewis is regularly instructed in personal injury matters on behalf of claimants and defendants.

He also accepts paperwork instructions including advices, schedules, and pleadings in all personal injury related matters including road traffic accidents, occupiers’ liability, the Highways Act 1980, employers’ liability, and cases involving fundamental dishonesty.

Lewis regularly accepts instructions on a CFA basis.

Recent successes include:

  • Securing findings of fundamental dishonesty in reserve judgment following claims made by a husband and wife following an RTA.
  • Acting on behalf of a local authority in a successful appeal concerning the Highways Act 1980, overturing the first instance decision in its treatment of section 41 and the test for dangerousness.
  • Acting on behalf of a claimant injured in an accident at work in his claim pleaded at over £250,000.

Clinical Negligence

Lewis is keen to develop his practice in this area, having studied medical law.

He is happy to accept instructions to provide advice on liability, quantum and Part 36 offers, as well as to draft pleadings, schedules and counter schedules.

Lewis is developing his practice in this area and accepts instructions on behalf of both claimants and defendants.

Commercial

Lewis has experience of a range of commercial disputes, including claims arising from the sale of goods and services, indemnity agreements, construction works, and claims for contribution.

Recent cases include:

  • Acting for a claimant seeking an indemnity for negligent performance of contract works.
  • Settling a defence and additional claim in respect of a claim brought against a principal contractor following the conclusion of a workplace personal injury claim.
  • Acting for an international clothing company in a multi-track claim brought against its distributor for breach of contract.
  • Advising a defendant in respect of an alleged breach of the contractual termination provisions of a construction contract in a claim presented against it for over $2 million.

International & Travel

Lewis has experience in a wide range of cross-border disputes, particularly involving foreign based insurers.

Lewis also regularly acts in all forms of travel claims such as travel delay, holiday sickness, and associated matters. Lewis has acted in a number of claims concerning the Montreal Convention, and has particular expertise in international freight claims (made under the respective conventions concerning carriage by rail, air and road).

Lewis frequently acts for large airlines and tour operators in a variety of claims made against them.

Recently, Lewis has undertaken a placement within the Office of the Attorney General of the British Virgin Islands (being called to the Bar of the Eastern Caribbean Supreme Court in the process). Lewis gained further experience of cross-border disputes and accepts instructions in matters concerning BVI law.

Recent cases include:

  • Representing an airline at trial in respect of a claim made against it following an incident at Heathrow Airport.
  • Advising a food manufacturer in respect of a claim made it against a transport company following the negligence transport (and subsequent damage) suffered to a shipment of frozen pizzas.
  • Securing the dismissal of a holiday sickness claim presented by a whole family.
