Acting for the Home Office, Ryan Ross has successfully resisted a judicial review challenge to a certification decision under s 94 and 94B of the Nationality, Immigration and Asylum Act 2002.
The Upper Tribunal (UTJ Kamara) accepted Ryan’s submission that the challenge was in substance only to the s 94 certification, before going on to reject the Applicant’s late attempt to amend the claim to challenge the s94B decision. The Judge then dismissed the claim on the basis that the Applicant had a suitable alternative remedy in the form of an appeal from abroad against the s 94 certification.
