Carwyn is a personal injury practitioner with over 20 years experience, recognised as a Leading Junior in Chambers UK and Legal 500.

Carwyn is regularly instructed in high value, complex, road traffic, public liability, employers’ liability and fatal accident claims in the UK.  As a result of his involvement in such claims, Carwyn frequently handles matters involving significant injuries, such as brain injury, amputation and chronic pain. His expertise also sees him in attendance at inquests on behalf of interested parties, following fatal accidents.

Carwyn has particular experience in working for local authorities and understands the complexities of the local authority environment.  This has led to him carrying out work in other areas in addition to his general practice including claims involving data protection.  In addition, he is currently instructed in a complex claim brought by a litigant in person who has significant mental health difficulties.

Carwyn also has significant experience in claims involving the care of vulnerable adults and children.  He understands the difficulties presented in the care sector.  The additional experience that Carwyn has with safeguarding as well as the interaction with local authorities assist him to add value to these claims.

Carwyn believes in providing a complete service for clients and tries to make himself available at the convenience of clients.  He regularly travels to see clients wherever they may be.  Carwyn also believes that the best results are achieved by working collaboratively and makes himself available whenever clients need to discuss matters.

Carwyn also specialises in the complimentary areas of clinical negligence, civil fraud, and is particularly experienced in inquests.

In 2018, Carwyn was appointed as a Recorder to the northern circuit and also chairs safeguarding appeals for the Football Association.

Personal Injury

Carwyn acts for Claimants and Defendants in complex multi-track matters. He regularly appears in Court conducting all matters such as applications, costs and case management conferences, joint settlement meetings and trials. Carwyn deals with all aspects of personal injury claims including road traffic accidents, public liability, employers’ liability, fatal accidents and clinical negligence.

Clinical Negligence

Carwyn is experienced in handling clinical negligence matters. Carwyn is currently instructed in a significant claim arising from a failure to adequately monitor the risks of developing a pulmonary embolism which led to a hypoxic brain injury. He has experience in claims involving negligent ACL reconstruction, failure to adequately diagnose an infection in the womb and informed consent in relation to a failed vasectomy reversal.

Inquests

Carwyn regularly attends inquests on behalf of interested parties. He has recently represented a sporting governing body at a recent inquest. He has particular experience representing local authorities. In addition, he has acted for emergency service employees.

Civil Fraud

Carwyn has acted in a number of matters where fraud and/or fundamental dishonesty have either been pleaded or pursued.

In the case of Abellio London Limited v Ahuja, Carwyn acted for Abellio London Limited in contempt proceedings brought by Abellio against Mr and Mrs Ahuja following findings of fundamental dishonesty made at the trial of their personal injury claim against Abellio London Limited, a trial in which he also acted. Mr Ahuja was committed to prison for 60 days and Mrs Ahiuja received a sentence of 28 days suspended for 6 months.

In addition, Carwyn acted for the Defendant in the case of McIntosh v ERS Claims Limited where the Claimant was found to have been fundamentally dishonest following a claim made arising from a road traffic accident. Carwyn also acted for Hertfordshire County Council in a case where the Claimant discontinued his claim following service of evidence showing that he had exaggerated the extent of the injuries that he had suffered.

International & Travel

Carwyn acts in claims arising from accidents abroad. He is an experienced personal injury practitioner and regularly handles complex, high value claims. He has recent experience of holiday sickness claims and the issues associated with them. Carwyn regularly deals with cases where allegations of fundamental dishonesty are raised and has recent experience of bringing contempt proceedings against dishonest litigants. He has also considered jurisdictional matters on several occasions.

Carwyn’s aviation experience includes claims under the Warsaw and Montreal Conventions. He has previously acted in respect of claims arising from accidents that have taken place on aircraft, as well as accidents occurring when transferring from one flight to another through an airport. The latter claim required detailed consideration of the nature and extent of an airlines obligations towards passengers, as well as the general duty of care of the airport under the Occupiers’ Liability Act 1957.

In addition to passenger claims, Carwyn has also acted in Employers’ Liability claims for employers. Carwyn has dealt with claims by baggage handlers as well as other airside employees.

In addition to civil proceedings, Carwyn has recently attended an inquest on behalf of an interested person, namely a bus driver involved in an airside accident resulting in the death of a construction worker at Heathrow Airport.

Carwyn acted for a Local Authority in this matter. The deceased had complex needs and had been placed at a school that specialised in the care of children with such needs. The Inquest resulted in a prevention of future death report directed at the school whilst the local authority were praised for their approach to the care of the deceased.

Inquest into the death of Maria Gauchi-Lamport

Carwyn acted for the Local Authority in this inquest. They were an interested party in the case as the Deceased was a resident in a residential unit run by a private company. The Coroner made findings that the Local Authority had taken reasonable steps to place the deceased despite criticisms of the management of the unit.

Inquest into the death of Sally Jane Lewis

Carwyn represents the Claimant in this complex brain injury claimed currently pleaded at in excess of £7m. The Claimant sustained a brain injury due to clinical negligence.

L (2025) (Ongoing)

Carwyn acted for the Defendant in this employer’s liability claim where the Claimant suffered a traumatic amputation to his index, middle and ring fingers when they were caught in a mincer. The claim was pleaded in excess of £1m. The claim recently settled at a JSM.

Adamov v Efez

Carwyn acted for the Defendant in this employers’ liability claim. Liability was admitted but causation and quantum were disputed. The Claimant alleged a deterioration of pre-existing cellulitis and sought substantial damages. The Defendant’s vascular expert attributed only minor injury to the accident. Given the complex medical and causation issues and litigation risk, the claim settled.

Gowers v Bifrangi UK Limited

Carwyn acted for the Defendant in this Occupiers’ Liability Act 1957 claim. Liability was admitted. The Claimant had pre-existing disabilities requiring mobility aids, including a scooter. A key issue was whether he could advance an accommodation claim on a Swift v Carpenter basis, whether another methodology applied, or no recovery was permitted. The claim settled at a JSM.

Howells v Treorchy and District Businessmen’s Club

Carwyn acted for the Defendant in a claim arising from the amputation of the Claimant’s left lower leg after a workplace accident. Aged 17 and working on a family friend’s farm, a heavy weight was dropped onto his leg, leading to amputation. He had intended to join the RAF as a pilot. Despite significant prosthetics claims in a multi-million pound action, the claim was compromised.

Murphy v Pryor Farms Ltd

Carwyn acted for the Claimant in this multi-track matter proceeding in the High Court. He was led by Rhiannon Jones QC. The Claimant was knocked over by a car suffering serious injuries, including a significant brain injury. Liability was disputed. In addition, complex arguments existed in respect of quantum and around the issue of capacity. The claim was compromised at a JSM and the settlement approved by the Court.

Carwyn represented Abellio in this road traffic accident claim. Liability for the collision was admitted, but the Defendant contended it was so minor the Claimants could not have sustained injury. After trial in the County Court, the claims by Mr and Mrs Ahuja were dismissed and they were found fundamentally dishonest. Abellio commenced committal proceedings and the contempt was admitted.

Abellio London Limited v Ahuja and Ahuja

A fatal workplace accident in which the deceased was crushed by the load he was delivering. Carwyn represented an interested party at the inquest. There were multiple interested parties, with the Coroner examining the complex delivery network and opportunities to check the load’s suitability before the accident. Carwyn attended several pre-inquest reviews; the full inquest is listed later this year.

Pop

Carwyn acted for the Defendant in this matter that arose as a result of an assault at school. The Claimant was claiming a substantial amount as a result of the psychological impact of the assault and other alleged incidents of bullying suffered. The claim was dismissed as the Claimant failed to establish that the school had breached their duty of care to the Claimant.

Hatt v Hertfordshire County Council

Carwyn represented the Defendant in this case where the Claimant suffered a traumatic amputation to his forefoot. Carwyn represented the Defendant at an interlocutory hearing and then at the JSM where the claim settled.
